Revolt of the Courts in Spain: it's official! the second state of emergency is declared unconstitutional
The Spanish Constitutional Court has just inflicted yet another slap on the socialist government led by Pedro Sanchez by declaring, on October 27, unconstitutional the second state of emergency which lasted 6 months without neither the Parliament nor the Constitution being able to control the government actions
In Spain, justice is in full revolt and the question to be asked is whether the rest of Europe will be inspired by it. Indeed, after having ordered the central government of Madrid to reimburse all the fines collected during the first state of health emergency of March 2020, the justice has just declared unconstitutional the second state of emergency which lasted from November 9, 2020 to 9 May 2021.
At least, this is the information our media obtained from several reliable sources on October 27. Thus, according to the newspaper El Pais , the verdict of the Constitutional Court was approved by 6 votes for against 4. It must be said that the information was announced on September 10 by Lecourrier-du-soir.com , but the verdict of the Court was not formalized until this Wednesday, October 27.
This Wednesday, the information was confirmed by other sources including the Spanish media, Infobae . According to this source, this verdict rendered on October 27 by the Court is a blow to the Spanish government led by Pedro Sanchez, after the first invalidation of the 1st State of Emergency by the same Court.
According to Infobae, which uses the same information as El Pais , the Constitutional Court mainly complained about the duration of the 2nd state of emergency, 6 months during which neither Parliament nor Congress were able to control the action of the government. . The Court also denounced the fact that the central government of Madrid took the place of the autonomous communities (Spanish regions) which nevertheless had the competence.
On October 27, the government's verdict sparked a strong reaction in the Spanish political class where the opposition, especially on the right, welcomed the slap inflicted on the socialist government. As a reminder, the Court had been seized on this question by the part of the Spanish far-right, Vox.
Thus, in a tweet posted on his personal account, the journalist Luis de Pino estimates that Vox won the match by 3 goals to 0. “Vox and the Constitution 3 - Pedro Sanchez 0”, he quipped.
Vox y la Constitución 3 - Pedro Sánchez 0

And he wasn't the only one. The harshest criticism comes from Hermann Tertsch, eminence grise of the Spanish far-right. “Sanchez's government and his gang sequestered the Spaniards for 6 months through a barbaric violation of the Constitution. This delinquent government must resign ”, he reacted.
El gobierno de Sánchez y su banda secuestró a los españoles 6 meses con una violación bárbara de la constitución. Este gobierno delincuente tiene que dimitir.

As a reminder, on October 22, the Spanish justice demanded from the central government that it reimburse citizens for all the fines imposed on them during the 1st state of emergency. Will he do the same for the second state of emergency? Logically, that's what he should be doing. We'll see.
