Twist in Spain: Justice demands reimbursement of all fines from the state of emergency
The Spanish government is in the process of reimbursing the fines collected during the first state of health emergency, a state of emergency declared unconstitutional by the Constitutional Court last September
The citizens opposed to the state of health emergency have just obtained a first victory in Spain. And this, a month after the verdict of the Constitutional Court which declared, last September, the state of emergency unconstitutional. The Tribunal then demanded that the government reimburse citizens for all fines imposed on them.
And the measure has now entered into force as confirmed, this October 22, several media consulted by Lecourrier-du-soir.com . Thus, according to information provided by the Spanish media ElDiario.es , the socialist government, led by Pedro Sanchez, requested that a work team be set up in order to reimburse the said fines.
The same information was confirmed by another Spanish media, Estenerife.com which provided more details on the number of fines that will be refunded. Thus, according to this source, 1,142,127 fines have been imposed on citizens since March 14, 2020, the date of entry into force of the first state of emergency in Spain.
Among the regions with the most fines are: Madrid (184,517) and Andalusia (195,986). But, in other parts of the country, many citizens resistant to the state of emergency have also faced sanctions. Thus, in Navarre, 12,500 fines will be reimbursed. In the region of Castilla y Leon, 59,299 fines will be reimbursed against 3,971 in Guadalajara.
Spain seems to be the only country in the European Union where the state of emergency has been declared unconstitutional by the Constitutional Court, which will eventually demand the reimbursement of all fines collected by the state during this period. Will the Spanish example be followed by other countries? That is the question!
Time will tell.
